The recognition and enforcement of foreign arbitral awards constitute a cornerstone of the contemporary international arbitration regime and serve as a decisive indicator of a State’s commitment to the rule of law and cross-border commercial cooperation. While the 1958 New York Convention provides a common international framework, its domestic implementation and judicial interpretation continue to differ across jurisdictions. This paper undertakes a comparative analysis of the enforcement of foreign arbitral awards in India, Russia, Belarus, and other European countries, which reflect distinct legal traditions yet increasingly participate in global commercial arbitration. The study examines the legislative frameworks governing enforcement, with particular focus on India’s Arbitration and Conciliation Act, as well as their interaction with international treaty obligations. Special attention is given to judicial practice concerning public policy, arbitrability, procedural fairness, and the scope of court intervention. Through analysis of leading court decisions, the paper demonstrates how each jurisdiction balances respect for arbitral autonomy against the protection of domestic legal order. The paper further explores recent reform trends and judicial developments aimed at enhancing enforceability and reducing uncertainty for foreign investors. By identifying convergences and divergences among the three systems, the study highlights practical challenges faced by award creditors and offers normative observations on how greater consistency and predictability may be achieved. The research contributes to ongoing debates on harmonisation in international arbitration and provides insights relevant to practitioners, scholars, and policymakers.
